In the County of Albany, sale of cigarettes, cigars, chewing tobacco, powdered tobacco, shisha or other tobacco products, herbal cigarettes, liquid nicotine, electronic cigarettes, rolling papers or smoking paraphernalia, to persons under 21 years of age is prohibited by law.


Adolescent Tobacco Use Prevention Act (ATUPA)

As of January 1, 2018 and to fulfill legal requirements of Article 13F (Section 1399-ee 5) of the New York State Public Health Law, below are listed violators of the provision prohibiting the sale of tobacco products or herbal cigarettes to youth under the age of 18 or for selling tobacco with a suspended or revoked registration. Such notification is to include the number of times the tobacco dealer has been in violation of this article. This information is published quarterly and includes dealers and/or vendors whose enforcement action has been finalized. A complete listing of all violators is also posted on the New York State Department of Health’s public website as part of the Youth Access Tobacco Enforcement Annual Report.
